Terms of Service

Welcome to myStoria, your digital fertility partner, here to support and
empower you on your journey.

Please carefully read and understand the following Terms of Service
("Terms") as they govern your use of our technology platform (the “myStoria
Platform”) through which our Services (as defined below) are delivered.  
The myStoria Platform is accessible via web browser and through our
mobile application (the “App”) available on iOS and Android. These Terms
apply to your use of the myStoria Platform regardless of the method of
access.  These Terms are between you and myStoria Inc. (“myStoria”).

When used in these Terms, the terms “us”, “we” and “our” refer to myStoria
and the term “you” means you as an individual registering to use the
myStoria Platform.  These Terms apply to your use of myStoria across all
platforms, including our website and mobile applications available on the
Apple App Store and Google Play Store.

By accessing or using our Services, you agree to be bound by these Terms.  
If you do not agree with any part of these Terms, please do not use our
myStoria Platform or Services.

#1 Acceptance of Terms
By using our Services, you agree to comply with and be bound by these
Terms. These Terms may be updated from time to time, and it is your
responsibility to review them periodically. Your continued use of the
myStoria Platform or Services after any changes to these Terms signifies
your acceptance of those changes.

#2 User Accounts
To access and use the myStoria Platform, you must register for a myStoria
account. You agree to provide accurate, current, and complete information
during the registration process and to update such information to keep it
accurate, current, and complete.  To complete your account registration,
you must provide us with your full legal name, address, phone number, a
valid email address, and any other information indicated as required. You
must be the older of: (i) 18 years, or (ii) at least the age of majority in the [{{type}} Annotation]
jurisdiction where you reside and from which you use the Services to open
an account.  You acknowledge that myStoria will use the email address you
provide on opening an account or as updated by you from time to time as
the primary method for communication with you. You are responsible for
maintaining the confidentiality of your account credentials, including
username and password, and for all activities that occur under your
account, including if you share the account with your partner.  myStoria
cannot and will not be liable for any loss or damage from your failure to
maintain the security of your account and password. We may request
additional security measures at any time and reserve the right to adjust
these requirements at our discretion. You agree to notify us immediately of
any unauthorized use of your account or any other breach of security.

#3 Services Provided
Through the myStoria Platform, we provide various technologies and tools
that support your reproductive health and fertility treatment journey,
including, but not limited to:

a) Fertility Health Assessment – A comprehensive tool to help patients
advocate with their doctor and guide them toward better care.
b) Your Fertility Profile – An easy-to-understand compilation of a user's
health journey, created to assist both them and their care providers.
c) Comprehensive Tracking  –  An easy-to-understand compilation of a
user's health journey, created to assist both them and their care providers.
d) Medical Document Organizer – A seamless solution for storing,
organizing, and accessing medical documents.
e) Artificial Intelligence (AI) Chabot  – A convenient AI-driven chatbot
that enables you to ask questions about and analyze your health information
to provide insights about your health journey.
f) Concierge Service – Access to knowledgeable staff, available when
users need some support .(collectively, the “Services”).  We reserve the
right to add to, modify, suspend, or discontinue any part of the myStoria
Platform or Services at any time by notifying you either through your email
address on record with us and/or by posting a notice on the myStoria
Platform

Service Availability: Our Services are currently only being offered to
individuals residing in Canada or the United States.

#4 Concierge Service
Our Concierge Service consists of various consultation and support services
offered by a team of knowledgeable staff who are here to support you on
your health journey through education, offering relevant suggestions to be
discussed with your healthcare provider, obtaining and uploading your
medical records to your profile and connecting you with experts. By utilizing
the Concierge Service, you consent to our Concierge Team accessing your
profile information and records within the myStoria Platform. While the
Concierge Service is recommended, it is not mandatory, and you may
choose to opt-out of using the service at any time. Communication with your
Concierge Team may take various forms, including live chat through the
myStoria Platform or app, video meetings and other channels that you may
authorize with your Concierge Team member.  To the extent that you choose
to communicate with our Concierge Team through channels other than the
myStoria Platform or app, we are not able to verify the security of such
channels and, therefore, it is your responsibility to take measures to
safeguard your information and privacy appropriately.

#5 Educational Materials
The myStoria Platform contains educational materials that are offered to
assist you in your health journey.  While we carefully select and create
articles and content that we consider to be potentially valuable to you, what
you do with the information remains at your sole discretion and we cannot
take responsibility for any decisions that you make in reliance on such
materials.  We encourage you to consult with your healthcare professional
when making any decisions about your care.

#6 Privacy and Confidentiality
Our team at myStoria understand the importance and sensitivity of the
information that you entrust to us when using the myStoria Platform, our
Concierge and other Services.  We commit to maintaining the
confidentiality, privacy and security of your information in accordance with
our Privacy Policy, which can be found here.‍

#7 myStoria Community on Circle
We have created a dedicated space moderated by our Concierge Team and
hosted on the Circle platform where you can connect with others, share
experiences, ask questions, and receive personalized guidance.  Please note
that while we have set up this forum for the benefit of our clients and
interested individuals, it does not form part of our Services or the myStoria
Platform.  As such, participation in the myStoria Community on Circle is
purely at your discretion and your use of the Circle platform for this
purpose is subject to the Circle’s terms and conditions, including privacy
policies as it may apply to any information that you share on the platform.  
Under these Terms, which only govern your use of the myStoria Platform
and other Services, myStoria does not take any responsibility for any
content that you post to the forum on Circle.

#8 Intellectual Property
myStoria alone (and its third-party licensors, where applicable) shall own all
right, title and interest, including all related intellectual property rights, in
and to the myStoria Platform and the Services. You agree that you may not
use any trademarks, logos, or service marks of myStoria, whether
registered or unregistered (“myStoria Trademarks”) unless you are
authorized to do so by myStoria in writing. You agree not to use or adopt
any marks that may be considered confusing with the myStoria Trademarks.
You agree that any variations or misspellings of the myStoria Trademarks
would be considered confusing with the myStoria Trademarks.

#9 Payments and Fees
Through the myStoria Platform you will be able to purchase various
Services by making service selections or otherwise updating your account
information. You agree to pay any and all applicable fees and charges
associated with the Services, under additional terms and conditions that
may be further communicated and defined within the myStoria Platform
accordingly, that you have purchased using one or more of the payment
options offered from time-to-time on the myStoria Platform. We reserve the
right to change the pricing and fees associated with the Services at any
time, and such changes will be effective as of the date indicated in the
notice either communicated to you by email and/or posted on the myStoria
Platform.

#10 Code of Conduct
You agree not to engage in any conduct that violates these Terms,
applicable laws, or the rights of others.  You agree not to reproduce,
duplicate, copy, sell, resell or exploit any portion of the myStoria Platform
without the express written permission of myStoria.You agree not to work
around, bypass, or circumvent any of the technical limitations of the
myStoria Platform, use any tool to enable features or functionalities that are
otherwise disabled in the myStoria Platform, or decompile, disassemble or
otherwise reverse engineer the myStoria Platform.  You agree not to access
the myStoria Platform or monitor any material or information from the
myStoria Platform using any robot, spider, scraper, or other automated
means.  myStoria may, at its discretion, suspend or terminate the accounts
of users who violate these Terms or engage in inappropriate conduct.

#11 Mobile App Permissions
When using our mobile application, you may be asked to grant access to
certain features of your device such as the camera, microphone, or photo
library. Granting these permissions is optional but may be required for
certain features to function. You are responsible for managing these
permissions in your device settings. myStoria does not access your device
features without your explicit consent.

#11 App Store Terms Apply
Your use of the myStoria mobile applicationApp is also governed by the
terms of service and privacy policy of the platform third-party app store
from which you downloaded the app App (e.g., Apple App Store, Google Play
Store). Any rights or remedies provided by those platformsthe applicable
app store remain unaffected by these Terms.
#12 Indemnity and Limitation of Liability
Except as otherwise stated explicitly in these Terms, the Services are
provided on an “as is” and “as available” basis without any warranty or
condition, express, implied or statutory.  myStoria does not warrant that the
Services will be uninterrupted, timely, secure, or error-free.  myStoria does
not warrant that the quality of any products, services, information, or other
materials obtained by you through the Services is suitable for your
particular purposes, including whether they will improve your health
outcomes or achieve your reproductive health goals.  In no way should
myStoria be considered providing health or medical advice or treatment, or
as a substitute for seeking the care you need from qualified health
professionals.
myStoria shall not be liable for any direct, indirect, incidental, special,
consequential or exemplary damages, including but not limited to, damages
for loss of use, data or other intangible losses arising out of or relating to
the use of or inability to use the Service (however arising, including
negligence).  In no event shall myStoria be liable for any damages resulting
from unauthorized access to or use of your personal or health-related
information, or any changes made to such information by any unauthorized [{{type}} Annotation]
party.  While we implement reasonable security measures to protect
sensitive health data, you acknowledge and agree that myStoria does not
guarantee absolute security and shall not be held responsible for any
breach of security, loss, or theft of your health data due to events beyond
our reasonable control, including but not limited to, cyberattacks, technical
failures, or natural disasters. You agree that you shall indemnify and hold
harmless myStoria, its affiliates, licensors, and each of their officers,
directors, other users, employees, attorneys and agents from and against
any and all claims, costs, damages, losses, liabilities and expenses
(including reasonable legal fees and costs) arising out of or in connection
with: (i) your violation or breach of these Terms or any applicable law or
regulation; (ii) your violation of any rights of any third party; or (iii) your
use or misuse of the Services.

#13 Not a Medical Device or Care Provider
The myStoria platformPlatform, including its mobile application, including
the Ferti by myStoria AI chatbot (“Chatbot”), is not intended to
function as a medical device, nor does it provide medical advice, diagnosis,
or treatment. All information and support offered is educational and
organizational in nature. Any health-related decisions should be made in
consultation with a licensed healthcare provider.  myStoria does not author,
review, or verify the accuracy, completeness, or appropriateness of any
Chatbot responses. The content generated by the Chatbot is produced by an
AI model and may be inaccurate, misleading, or inappropriate.  myStoria
does not endorse any specific information, opinions, advice, products, or
services that may be mentioned in Chatbot outputs. Use of the Chatbot is at
your own risk, and myStoria disclaims all liability for any harm or loss
arising from your reliance on any information provided by the Chatbot.

#14 License to Use the Mobile Application
Subject to your compliance with these Terms, we grant you a limited, non-
exclusive, non-transferable, revocable license to download and use the
mobile applicationApp on your personal device solely for your personal,
non-commercial use in connection with myStoria servicesServices.  We may
from time to timetime-to-time issue updates to the mobile applicationApp
which may add, modify, or remove features. Continued use of the app App
after such updates constitutes your acceptance of the changes. You are
solely responsible for ensuring that your device meets all technical
requirements for using the App and for any carrier or data charges incurred
through your use of the myStoria Platform. We are not responsible for any
lack of functionality due to outdated app App versions or unsupported
devices.

#15 Termination
You may cancel your subscription to the Services at anytime either by
updating your account on the myStoria Platform or by contacting myStoria
Support using the information contained in the Support section of these
Terms. myStoria may suspend or terminate your access to the myStoria
Platform or Services at any time for any reason, including if you breach any
of the terms and conditions in these Terms. Upon termination of Services,
your information within the myStoria Platform will be administered in
accordance with the Data Retention provisions of our Privacy Policy.

#16 Governing Law
These Terms shall be governed by and construed in accordance with the
laws of Ontario, Canada and to the fullest extent permitted by applicable
law, you agree to irrevocably and unconditionally submit to the exclusive
jurisdiction of the courts of the Ontario, Canada with respect to any dispute,
controversy or claim arising out of or in connection with these Terms or
your use of the Services.

#17 Waiver of Class Proceedings
To the extent permitted under applicable law, and except where explicitly
prohibited under statute, you hereby waive any right they may have to
commence or participate in any class action lawsuit against myStoria,
including their officers, directors, members, employees, affiliates, or agents,
related to any claim, dispute or controversy arising out of or related to the
Agreement. Where applicable, you hereby agree to opt out of any class
proceeding against myStoria.

#18 Additional Terms
The failure of myStoria to exercise or enforce any right or provision of these
Terms shall not constitute a waiver of such right or provision. If any
provision of these Terms is found by a court of competent jurisdiction to be
invalid, the other provisions of these Terms will remain in full force and
effect. We may assign, transfer, or subcontract any or all of our rights or
obligations under these Terms to any third party without your consent or
notice to you. These Terms constitutes the entire understanding between
you and myStoria and supersedes all prior agreements, whether oral or
written, relating to your use of the myStoria Platform or Services.

these Terms, is available to myStoria Platform users by contacting myStoria
